Terms and Conditions: FoxPro Services

FoxPro Services agrees to perform the work described in the written Estimate or Invoice provided to the Client. Any changes to the original scope of work must be agreed upon in writing and may result in a revised Estimate.

The Total Fixed Price and the Payment Schedule (including deposit, interim, and final payments) are detailed in the Estimate/Invoice.

Payments not received within 15 days of the due date specified on the invoice will incur a flat late fee per month, based on the Total Fixed Price:

• Invoices under $250: $20.00 per month
• Invoices $250 and over: $35.00 per month

The responsibility for materials and supplies is defined on a line-item basis within the Scope of Work on the referenced Estimate/Invoice.

• If FoxPro Services supplies the materials, the cost will be listed in the relevant line items.
• If the Client supplies the materials, the relevant line items will explicitly state “Labor Only” or “Client-Provided Materials.”

The Client may pay using Cash, Check (made payable to FoxPro Services), or via the digital Stripe invoice (credit card, debit card, or ACH bank transfer).

• Processing Fee (Pass-Through): The Client agrees to pay a non-refundable processing fee of 3% (three percent) on all electronic payments (credit card, debit card, or other non-ACH transactions) to cover transaction costs, where permitted by law.
• No processing fee is charged for Cash, Check, or ACH payments.

• Project Commencement: Work will be scheduled to commence upon mutual agreement and FoxPro Services’ receipt of the initial deposit payment detailed in the Invoice.
• Delays: FoxPro Services is not liable for delays caused by the Client, material shortages, inclement weather, or other events beyond our reasonable control (Force Majeure). FoxPro Services will notify the Client of any anticipated delays promptly.

FoxPro Services maintains General Liability Insurance to protect both the business and the Client. Our coverage includes:

• Per-Occurrence Limit: $1,000,000 (Maximum paid for any single incident).
• Aggregate Limit: $2,000,000 (Maximum total paid for all covered claims during the policy period).

The Client agrees that FoxPro Services’ total liability for any claims shall not exceed these policy limits. FoxPro Services is not liable for any indirect, incidental, or consequential damages.

FoxPro Services warrants that all services will be performed in a professional, workmanlike manner.

• Warranty Period: We provide a 90-day warranty on labor from the date of completion.
• Exclusions: This warranty does not cover issues arising from normal wear and tear, client negligence, or pre-existing structural issues.
• Remedy: If a workmanship defect is reported within the warranty period, FoxPro Services will inspect and, if necessary, repair the defect at no additional cost.

The Client grants FoxPro Services permission to take photographs or videos of the work performed.

• Usage: These images may be used for promotional purposes (social media, website, etc.).
• Privacy: We will not disclose the Client’s full name or exact street address in any public marketing.
• Opt-Out: The Client may opt out by notifying FoxPro Services in writing prior to the start of work.

• Governing Law: This Contract shall be governed by the laws of the State of Pennsylvania.
• Dispute Resolution: The parties agree to first attempt to resolve any dispute directly through good faith negotiation. Failing negotiation, the parties agree to resolve the dispute by Binding Arbitration in Bucks County, Pennsylvania.
